** The basic claim
is arisen due to Commissioner Appeals
Order (Goa/CUS/MP/60&61/2007 dt.
12.11.07). Department has filed an
appeal with CESTAT with Stay
application against said Commissioner
Appeal’s Order. The STAY
application was rejected by CESTAT.
Party went to High Court for failure
of the Department to comply with an
order of CESTAT (dt. 26.3.2008) and
department also filed an appeal with
High Court against Order dated
26.3.2008 passed by the CESTAT. Both
the appeals are pending before the
High Court.
